Question: Licensing Wedding Photos.....?

My husband and I are in the process of creating a small home based business to sell some of our art work (mostly Jewelry and Pottery, some Photography). A friend of ours has asked us to photograph her wedding. She wants us to put the photos on a cd so she can print them. We are ok with this, but we would like to know how to license the photos. We thought about doing a Creative Commons License with Attribution Non-Commercial Share-Alike. We are ok with her making derivatives (editing, etc.) but at the same time we don't want something that ends up looking bad to have our name on it. Also, we would like to retain the right to edit the photos how we see fit and use them in our portfolio as we build our business. What is the best way to accommodate each of our needs?

Answer: In most states the person that clicks the shutter owns copyright unless stated somewhere else otherwise. She should be signing a contract that states she is not allowed to edit (there should be no in between with this, she can either edit them or not edit them). The contract should also contain a model release for you to use for advertising purposes and a clause that allows you to maintain copyright and to acknowledge that she can only use them for personal purposes (and not attempt to sell them or things of the like).
